  1. Introduction and Scope
    This Privacy Policy explains in comprehensive detail how NextQuark (“we,” “our,” or “us”) collects, uses, stores, processes, shares, and protects your information when you access or use our mobile application (available on iOS and Android), our website, and all related services, features, and tools (collectively referred to as the “Service”). By downloading, installing, accessing, or using NextQuark, you acknowledge that you have read, understood, and agree to the practices described in this Privacy Policy.
    NextQuark is a job discovery and application assistance platform designed to help users find job opportunities and assist in completing job applications across multiple company career portals. To deliver this functionality, the Service processes certain personal, professional, and technical data. We are committed to ensuring that your data is handled transparently, securely, and in full compliance with applicable data protection laws and regulations, including but not limited to the European Union General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA) and its amendment the California Privacy Rights Act (CPRA), India’s Digital Personal Data Protection Act 2023 (DPDP Act), the Children’s Online Privacy Protection Act (COPPA), and the requirements set forth by Apple’s App Store Review Guidelines and Google’s Play Store policies.
    This Privacy Policy applies to all users of the Service worldwide. If you do not agree with any part of this Privacy Policy, you should discontinue use of the Service immediately. We encourage you to read this document in its entirety and to revisit it periodically, as it may be updated from time to time.


  2. Definitions and Interpretation
    “Personal Data” means any information that relates to an identified or identifiable natural person. This includes, but is not limited to, names, email addresses, phone numbers, device identifiers, IP addresses, employment history, educational records, and any other information that can be used directly or indirectly to identify you.
    “Processing” means any operation or set of operations performed on Personal Data, whether or not by automated means, including collection, recording, organization, structuring, storage, adaptation, alteration, retrieval, consultation, use, disclosure by transmission, dissemination, alignment, combination, restriction, erasure, or destruction.
    “Data Controller” refers to NextQuark, which determines the purposes and means of processing Personal Data collected through the Service.
    “Data Processor” refers to any third party that processes Personal Data on behalf of NextQuark, such as cloud hosting providers or analytics services.
    “Data Principal” refers to you, the individual whose Personal Data is being processed, as defined under India’s DPDP Act.
    “Consent” means any freely given, specific, informed, and unambiguous indication of your wishes by which you, by a clear affirmative action, signify agreement to the processing of your Personal Data.
    “Third-Party Job Portal” means any external career website, recruitment platform, or employer application portal that NextQuark interacts with on your behalf to assist in completing job applications.


  3. Information We Collect
    3.1 Information You Provide Directly
    3.1.1 Account and Identity Information
    When you create an account or register with the Service, we collect personal identifiers necessary to establish and maintain your account. This includes your full name, email address, phone number, and login credentials (username and password or authentication tokens from third-party sign-in providers such as Apple Sign-In or Google Sign-In). If you choose to sign in using Apple Sign-In, we may receive a unique, anonymized email address generated by Apple’s Hide My Email feature, along with your name (if you choose to share it). If you sign in using Google, we receive your name, email address, and profile photo URL as authorized by your Google account settings.
    3.1.2 Professional and Career Profile Data
    To support job application workflows, we collect and process a wide range of professional and career-related information. This includes your resume or curriculum vitae (CV), employment history (including job titles, employer names, dates of employment, and job responsibilities), educational background (including institutions attended, degrees obtained, fields of study, and graduation dates), professional skills and competencies, certifications and licenses, professional achievements and awards, portfolio links and work samples, and any other information you choose to include in your professional profile.
    3.1.3 Job Preferences and Search Criteria
    We collect information about your job search preferences, including desired job titles and roles, preferred industries and sectors, desired geographic locations (city, state, country, or remote work preferences), salary expectations and compensation requirements, employment type preferences (full-time, part-time, contract, freelance, internship), availability and start date preferences, willingness to relocate, and any other criteria you specify to filter or refine job recommendations.
    3.1.4 Application-Specific Responses
    When you use NextQuark to apply for jobs, we collect and store your responses to job-specific application questions. This may include cover letters, answers to screening questions, responses to diversity and equal opportunity questionnaires (provided on a voluntary basis), work authorization status, availability for interviews, references and referral information, and any other information you provide in connection with a specific job application.
    3.1.5 Communication and Correspondence Data
    If you contact us for support, provide feedback, or communicate with us through any channel (including in-app messaging, email, or social media), we collect the content of those communications, along with associated metadata such as timestamps, sender information, and any attachments.
    3.2 Information Collected Automatically
    3.2.1 Device and Technical Information
    When you access or use the Service, we automatically collect certain technical information about your device and connection. This includes your device type, model, and manufacturer; operating system type and version; app version and build number; unique device identifiers (such as IDFV on iOS); screen resolution and display metrics; language and locale settings; time zone; available storage and memory; and network connection type (Wi-Fi, cellular, etc.).
    3.2.2 Usage and Interaction Data
    We collect data about how you interact with the Service, including jobs you view, save, bookmark, swipe on, or apply to; search queries and filters you use; features you access and how frequently; timestamps and duration of sessions; navigation paths and screens visited; interactions with notifications (opens, dismissals); application statuses and progress tracking; and logs of automation-related actions taken by the Service on your behalf.
    3.2.3 Log and Diagnostic Data
    We collect system log data and diagnostic information to maintain the stability, security, and performance of the Service. This includes IP addresses, crash reports, error logs, performance metrics, API call logs, and debugging data. This data may be collected through Apple’s built-in crash reporting framework or third-party diagnostic tools.
    3.2.4 Location Data
    We may collect coarse (approximate) location data derived from your IP address to provide location-relevant job recommendations. We do not collect precise GPS-based location data unless you explicitly grant permission through your device’s location services settings. You may disable location access at any time through your device settings.
    3.3 Information from Third-Party Sources
    We may receive information about you from third-party sources in connection with the Service. This may include information from third-party sign-in providers (such as Apple or Google) when you choose to authenticate using these services; publicly available professional profile data (such as data from LinkedIn or other public professional networks) if you choose to import or link such profiles; and information from third-party job portals that provide application status updates, interview scheduling, or other recruitment-related data.
    3.4 Cookies, Tracking Technologies, and Analytics
    Our website and Service may use cookies, web beacons, pixels, local storage, and similar tracking technologies to collect usage data, remember your preferences, and improve the Service. We use essential cookies that are strictly necessary for the operation of the Service (such as session management and authentication), functional cookies that remember your preferences and settings, and analytics cookies and tools that help us understand how users interact with the Service. You can manage cookie preferences through your browser or device settings. Disabling certain cookies may affect the functionality of the Service.
    3.5 System-Generated Identifiers
    In some cases, the Service may generate system-managed identifiers, such as internal user IDs, session tokens, device tokens for push notifications, or temporary email identifiers, to facilitate application workflows, communication handling, and service delivery. These identifiers are used solely for operational purposes and are not shared with third parties for marketing or advertising purposes.


  4. Legal Bases for Processing (GDPR Compliance)
    For users located in the European Economic Area (EEA), the United Kingdom, or other jurisdictions where GDPR or equivalent data protection laws apply, we process your Personal Data only when we have a valid legal basis to do so. The legal bases we rely on include the following:
    Consent: Where you have given explicit, informed consent for a specific processing purpose, such as connecting your email for application tracking, enabling push notifications, or allowing automated application features. You may withdraw consent at any time (see Section 9).
    Performance of a Contract: Processing that is necessary to fulfill our obligations under the terms of service or agreement between you and NextQuark, such as creating and maintaining your account, processing job applications on your behalf, and providing core application assistance features.
    Legitimate Interests: Processing that is necessary for our legitimate business interests, provided those interests are not overridden by your data protection rights. This includes improving the Service, detecting and preventing fraud or misuse, conducting analytics and research, and ensuring the security and stability of the platform.
    Legal Obligation: Processing that is necessary to comply with applicable legal obligations, such as responding to lawful requests from government authorities, complying with tax or regulatory requirements, or preserving data that may be relevant to legal proceedings.


  5. How We Use Your Information
    5.1 Core Service Delivery
    We use your information to provide, operate, and maintain the core features of NextQuark. This includes enabling job discovery by matching your preferences and profile with available job opportunities; assisting in completing and submitting job applications on your behalf across supported third-party job portals; storing and reusing your profile data (resume, employment history, skills, etc.) to pre-fill application forms and reduce repetitive data entry; tracking application progress and providing status updates; processing verification steps such as OTP (one-time password) inputs and email confirmations when necessary to complete applications; and providing you with a personalized dashboard showing your application history, saved jobs, and activity.
    5.2 Personalization and Recommendations
    We use your profile data, job preferences, interaction history, and behavioral patterns to personalize your experience within the Service. This includes recommending relevant job listings, suggesting profile improvements, highlighting trending opportunities in your field, and tailoring the user interface to your usage patterns.
    5.3 Communication and Notifications
    We use your contact information and communication preferences to send you transactional notifications related to your applications (such as submission confirmations, interview invitations, and status updates); service-related alerts (such as account security notifications, maintenance notices, and feature announcements); optional marketing communications and newsletters about new features, tips, or opportunities (which you can opt out of at any time); and responses to your support requests or feedback.
    5.4 Analytics, Research, and Improvement
    We use aggregated, de-identified, and anonymized data for internal analytics, research, and development purposes. This includes analyzing usage patterns to identify popular features and areas for improvement; conducting A/B testing and product experiments; generating statistical reports and trend analyses; improving our algorithms for job matching, recommendation, and application assistance; and monitoring system performance, uptime, and reliability.
    5.5 Safety, Security, and Fraud Prevention
    We use your information to protect the security and integrity of the Service and our users. This includes detecting, preventing, and responding to fraud, abuse, security incidents, and other harmful activity; enforcing our terms of service and usage policies; authenticating users and preventing unauthorized access; and monitoring for and responding to potential data breaches.
    5.6 Legal and Compliance Purposes
    We may process your information as necessary to comply with applicable laws, regulations, and legal processes; respond to lawful requests from governmental authorities; establish, exercise, or defend legal claims; and meet regulatory reporting and audit requirements.


  6. Automation and Third-Party Interactions
    6.1 Automated Application Assistance
    NextQuark may, with your explicit permission and active initiation, interact with third-party job portals and career websites to assist you in completing job applications. This automated assistance may involve pre-filling application forms with your stored profile data; uploading your resume and supporting documents to employer application systems; submitting completed applications on your behalf; handling verification steps such as OTP inputs, CAPTCHA responses, and email confirmations; and retrieving application status updates from employer portals.
    You retain full control over which applications are submitted and can review application details before any submission is made. Automated features can be enabled or disabled at any time through the app’s settings.
    6.2 Email Integration and Processing
    If you choose to connect or use an email address within the Service, we may process job-related email communications to the extent necessary to enable application completion and tracking features. This may include processing verification emails and OTP codes sent by employers or job portals; reading application confirmation emails to update your application status; parsing interview invitation emails to extract scheduling information; and identifying employer responses and recruiter communications. We only access and process email content that is directly related to your job search and application activity. We do not access, read, or process personal emails unrelated to the Service.
    6.3 Third-Party Platform Disclaimer
    Third-party job portals, career websites, and employer application systems operate independently and have their own privacy policies, terms of service, and data handling practices. NextQuark does not control how these third parties collect, use, store, or protect your data once it has been submitted to their platforms. We strongly encourage you to review the privacy policies of any third-party platform you interact with through the Service. NextQuark is not responsible for the privacy practices, content, or actions of any third-party platform.


  7. Sharing and Disclosure of Information
    7.1 No Sale of Personal Data
    NextQuark does not sell, rent, lease, or trade your Personal Data to third parties for monetary or other valuable consideration. We do not participate in data brokerage or share your data with advertisers for targeted advertising purposes without your explicit consent.
    7.2 Sharing with Employers and Job Portals
    When you use NextQuark to apply for a job, relevant information is shared with the employer or job portal as part of the application process. This may include your resume, professional profile details, application responses, and any other information required by the specific job application. This sharing occurs only at your direction and as necessary to complete the application you have initiated.
    7.3 Third-Party Service Providers
    We engage trusted third-party service providers to assist us in operating, maintaining, and improving the Service. These service providers may have access to your Personal Data only to the extent necessary to perform their functions on our behalf. Categories of service providers include cloud hosting and infrastructure providers (for secure data storage and computing); database management and backup services; analytics and performance monitoring tools; push notification delivery services; email infrastructure and delivery providers; customer support and ticketing platforms; payment processing services (if applicable); and security and fraud prevention tools. All third-party service providers are bound by contractual obligations to process your data only for specified purposes, maintain appropriate technical and organizational security measures, and comply with applicable data protection laws. We conduct due diligence on our service providers and regularly review their data protection practices.
    7.4 Legal and Regulatory Disclosures
    We may disclose your information if required or permitted to do so by applicable law, regulation, legal process, or governmental request. This includes responding to court orders, subpoenas, or other lawful requests from law enforcement or regulatory authorities; complying with tax, regulatory, or auditing requirements; protecting the rights, property, or safety of NextQuark, our users, or the public; enforcing our terms of service, privacy policy, or other agreements; and detecting, preventing, or addressing fraud, security vulnerabilities, or technical issues.
    7.5 Business Transfers
    In the event of a merger, acquisition, reorganization, bankruptcy, asset sale, or other business transaction involving NextQuark, your Personal Data may be transferred to the acquiring entity or successor organization. In such event, we will provide notice to affected users and ensure that the receiving entity is bound by privacy obligations at least as protective as those described in this Privacy Policy. You will have the opportunity to withdraw consent or request deletion of your data before or after such a transfer.
    7.6 Aggregated and De-Identified Data
    We may share aggregated, anonymized, or de-identified data that cannot reasonably be used to identify any individual. This data may be shared with partners, researchers, or the public for statistical analysis, industry benchmarking, or research purposes.

  8. Data Retention and Deletion
    8.1 Retention Periods
    We retain your Personal Data only for as long as necessary to fulfill the purposes for which it was collected and as described in this Privacy Policy. The specific retention period depends on the nature of the data, the purposes of processing, applicable legal obligations, and operational requirements. In general, active account data (including profile information, application history, and preferences) is retained for as long as your account remains active; application-related data (including submitted applications, responses, and status information) is retained for up to 36 months after the last application activity or as required by applicable law; technical and diagnostic data (including logs, crash reports, and performance metrics) is retained for up to 12 months; and communication records (including support requests and feedback) are retained for up to 24 months.
    Under India’s DPDP Rules 2025, we are required to retain personal data, related traffic data, and logs for a minimum of one year from the date of processing for law enforcement and other lawful purposes. We comply with this obligation where applicable.
    8.2 Account Deletion
    You may request deletion of your account and all associated Personal Data at any time. You can initiate account deletion directly within the app through the account settings or profile management section. Upon receiving a valid deletion request, we will delete or irreversibly anonymize your Personal Data within 30 days, except where retention is required for legal, security, regulatory, or legitimate business purposes (such as complying with tax obligations, resolving disputes, or enforcing our agreements). Some residual data may remain in encrypted backups for a limited duration (typically up to 90 days) before being permanently purged. We will confirm deletion of your account via your registered email address. If you have any active subscriptions, you will be guided to cancel them before account deletion is finalized.
    8.3 Automated Deletion Notification
    Where required by applicable law (such as India’s DPDP Rules), we will notify you at least 48 hours before any automated deletion of your Personal Data upon expiration of the applicable retention period.


  9. Your Rights and Choices
    9.1 Universal Rights
    Regardless of your location, you have the following rights with respect to your Personal Data held by NextQuark:
    Right of Access: You may request a copy of the Personal Data we hold about you, along with information about how it is processed.
    Right to Rectification: You may request correction of any inaccurate or incomplete Personal Data we hold about you.
    Right to Deletion (Right to Erasure): You may request that we delete your Personal Data, subject to certain exceptions (such as legal retention requirements).
    Right to Withdraw Consent: Where processing is based on your consent, you may withdraw that consent at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.
    Right to Data Portability: You may request that we provide your Personal Data in a structured, commonly used, and machine-readable format (such as JSON or CSV) so that you can transfer it to another service provider.
    9.2 Additional Rights Under GDPR (EEA/UK Users)
    If you are located in the European Economic Area or the United Kingdom, you also have the right to restrict processing of your Personal Data in certain circumstances; the right to object to processing based on legitimate interests, including profiling; the right not to be subject to decisions based solely on automated processing that produce legal or similarly significant effects; and the right to lodge a complaint with your local data protection supervisory authority.
    9.3 Additional Rights Under CCPA/CPRA (California Residents)
    If you are a California resident, you have additional rights under the CCPA and CPRA, including the right to know what Personal Data we have collected, the categories of sources, the business or commercial purpose for collection, and the categories of third parties with whom we share it; the right to opt out of the sale or sharing of your Personal Data (note: NextQuark does not sell your Personal Data); the right to limit the use of sensitive Personal Data to purposes necessary to provide the Service; and the right to non-discrimination for exercising any of your privacy rights.
    9.4 Rights Under India’s DPDP Act (Indian Users)
    If you are a user in India, you have rights under the Digital Personal Data Protection Act 2023, including the right to access information about the Personal Data being processed and a summary of the processing activities; the right to correction and erasure of your Personal Data; the right to nominate another individual to exercise your rights in the event of your death or incapacity; the right to have grievances addressed in a timely manner; and the right to withdraw consent, which shall be as easy as the process of giving consent. We will process all data principal rights requests within the timeframes prescribed by the DPDP Act and its rules.
    9.5 How to Exercise Your Rights
    You may exercise your rights through the in-app settings and privacy management features, or by contacting us at support@nextquark.in with the subject line “Privacy Rights Request.” We will verify your identity before processing any request and will respond within the timeframes required by applicable law (typically 30 days under GDPR, 45 days under CCPA/CPRA, or as prescribed under the DPDP Act). We will not charge a fee for processing your request unless it is manifestly unfounded or excessive, in which case we may charge a reasonable fee or refuse the request as permitted by law.


  10. App Tracking Transparency and Advertising
    10.1 No Cross-App Tracking
    NextQuark does not track users across third-party apps or websites owned by other companies for the purpose of delivering targeted advertising. We do not use Apple’s IDFA (Identifier for Advertisers) or any equivalent cross-app tracking identifier without your explicit opt-in consent.
    10.2 Apple App Tracking Transparency (ATT)
    In compliance with Apple’s App Tracking Transparency framework (introduced in iOS 14.5), NextQuark will request your permission through the standard ATT prompt before engaging in any form of tracking activity that links your data with data from third-party apps or websites. If you deny tracking permission, we will not engage in any such tracking. If tracking capabilities are introduced in the future, they will be clearly disclosed through the ATT framework, and you will always have the option to opt in or opt out.
    10.3 Advertising
    NextQuark does not currently display third-party advertisements within the app. If advertising is introduced in the future, this Privacy Policy will be updated to reflect the types of ads displayed, any data used for ad targeting, the ad networks involved, and the options available to you for managing ad preferences and opting out of personalized advertising.


  11. Apple App Store Privacy Nutrition Labels
    As required by Apple, we provide privacy “nutrition labels” in our App Store listing that summarize our data collection and usage practices. These labels disclose the categories of data we collect, whether data is linked to your identity, whether data is used for tracking, and how each category of data is used (such as for app functionality, analytics, or product personalization). The information provided in our App Store privacy labels is consistent with the practices described in this Privacy Policy. We update our privacy labels whenever our data practices change.


  12. Privacy Manifests and Required Reason APIs
    In compliance with Apple’s privacy manifest requirements (effective May 2024), NextQuark includes a PrivacyInfo.xcprivacy file in the app bundle that declares in machine-readable format the types of data we collect, the reasons we access any Required Reason APIs (such as UserDefaults, file timestamps, disk space, system boot time, or other covered APIs), the third-party SDKs included in the app and their respective privacy practices, and the tracking domains used by the app (if any). All third-party SDKs integrated into NextQuark have been verified to include their own privacy manifests and valid signatures as required by Apple.


  13. Account Deletion and Subscription Management
    13.1 In-App Account Deletion
    In compliance with Apple’s App Store Review Guidelines (Section 5.1.1(v)), NextQuark provides a clearly accessible mechanism within the app for you to initiate deletion of your account. The account deletion feature is located in the app’s Settings or Profile section and is straightforward to use. Upon initiating account deletion, your account record and all associated Personal Data will be permanently deleted or irreversibly anonymized, your profile data, application history, saved jobs, and preferences will be erased, any system-generated identifiers associated with your account will be invalidated, and you will be guided through the process of canceling any active auto-renewing subscriptions before deletion is finalized.
    13.2 Post-Deletion Data Handling
    After account deletion, some data may be retained in encrypted, anonymized form within backup systems for up to 90 days before permanent purging. Aggregated, de-identified data derived from your usage (which cannot be used to identify you) may be retained for analytics and research purposes. Data that we are legally required to retain (such as records necessary for tax compliance, fraud prevention, or dispute resolution) will be securely stored for the minimum period required by law and then permanently deleted.


  14. Data Security
    14.1 Technical Safeguards
    We implement industry-standard and commercially reasonable technical security measures to protect your Personal Data from unauthorized access, disclosure, alteration, or destruction. These measures include encryption of data in transit using TLS/HTTPS protocols; encryption of sensitive data at rest using AES-256 or equivalent encryption standards; secure authentication mechanisms including hashed and salted password storage; role-based access controls restricting access to Personal Data to authorized personnel only; regular security assessments, vulnerability scanning, and penetration testing; intrusion detection and prevention systems; automated monitoring and alerting for anomalous activity; and secure API communications with third-party services.
    14.2 Organizational Safeguards
    In addition to technical measures, we maintain organizational safeguards including data protection training for all personnel who handle Personal Data; internal privacy policies and procedures governing data access and handling; incident response plans for data breach detection, containment, and notification; vendor management processes including security assessments of third-party service providers; and regular reviews and updates of our security practices in line with evolving threats and best practices.
    14.3 Limitations
    Despite our efforts, no method of data transmission over the internet or electronic storage is completely secure. While we strive to protect your Personal Data using commercially reasonable measures, we cannot guarantee absolute security against all potential threats. In the event of a data breach affecting your Personal Data, we will notify you and any applicable regulatory authorities in accordance with the timeframes and requirements of applicable law (72 hours under GDPR, as prescribed under India’s DPDP Act, or as otherwise required).


  15. International Data Transfers
    Your Personal Data may be transferred to and processed in countries other than your country of residence. These countries may have different data protection laws than your jurisdiction. When we transfer Personal Data internationally, we ensure that appropriate safeguards are in place to protect your data in accordance with applicable law. These safeguards may include Standard Contractual Clauses (SCCs) approved by the European Commission for transfers from the EEA; adequacy decisions by relevant data protection authorities; binding corporate rules or other approved transfer mechanisms; contractual protections with data recipients that ensure equivalent levels of data protection; and compliance with any applicable cross-border data transfer requirements under the DPDP Act. By using the Service, you acknowledge and consent to the transfer and processing of your Personal Data in jurisdictions outside your country of residence, subject to the safeguards described above.


  16. Children’s Privacy
    16.1 Age Restrictions
    NextQuark is not intended for use by individuals under the age of 18 (or the age of majority in your jurisdiction, whichever is higher). We comply with stricter age thresholds where required by local law, including under COPPA (which protects children under 13 in the United States), the GDPR (which requires parental consent for children under 16 in most EU member states), and India’s DPDP Act (which protects all individuals under 18). We do not knowingly collect, solicit, or process Personal Data from minors.
    16.2 Parental Notice and Verification
    If we become aware that we have collected Personal Data from a minor without appropriate parental or guardian consent, we will take immediate steps to delete such data and terminate the associated account. If you are a parent or guardian and believe that your child has provided Personal Data to NextQuark without your consent, please contact us immediately at support@nextquark.in and we will promptly investigate and take appropriate action.
    16.3 Age Verification
    We may implement age verification mechanisms as required by applicable laws, including the App Store Accountability Laws enacted in certain U.S. states (such as Texas and Utah). These mechanisms may include age attestation during account creation, compliance with App Store-level age verification tools, and other commercially reasonable methods of verifying user age.


  17. Do Not Track Signals
    Some web browsers transmit “Do Not Track” (DNT) signals to websites. There is currently no universally accepted standard for how to respond to DNT signals. As of the effective date of this Privacy Policy, NextQuark does not respond to or alter its data collection and use practices in response to DNT signals. If a uniform standard for responding to DNT signals is adopted in the future, we will update this Privacy Policy to describe our response.


  18. Third-Party Links and Services
